The Real Estate Contract in South Florida

 

Your dream home is located in South Florida and you are now ready to sign the contract.

Are you having trouble understanding everything on the Real Estate Contract?  No problem, just take a gander at the following information for an easier understanding before you sign.

First you will find yourself needing to sign a real estate purchase and sale contract.  Your Realtor will produce  this contract to the owner indicating your preference to buy the property.  This is not enforceable unless it is in writing.  South Florida requires all the parties in the transaction, the property, and the price to be listed.  The parties involved on the contract are the seller(s) and the buyer(s).

Most often you will see the FAR/BAR contract created by the Florida Bar and the Florida Association of Realtors. This will remain an offer until all parties involved come to an agreement and sign the contract. Once  both parties, buyers  and sellers agree to the terms and sign the contract the date noted is the “Effective Date” All time lines are based on this date.

Why Have a Pest Inspection in South Florida?

A pest inspection is a must in South Florida.

Typically your bank will require several  inspections when they lend you money to purchase a home in Forest Ridge.  One of these inspections will to determine if the home has an infestation of  termites. There are companies that specialize in pest inspection.

In particular,  your hired pest inspection company will be testing for termites.

This creatures  can cause an enormous amount of damage to the structure of a home. Their presence may not even be realized until it is far too late. A proper pest inspection could determine the presence of these pests which, in turn, allows you to take effective action to exterminate them immediately.

Here are our tips for selecting a Pest Inspection Company:

  1. Shop around for  a reasonable price.
  2. Check online services for recommendations and reviews.
  3. As for a written report of findings.
  4. If you are not familiar with damage caused, ask to see evidence.
  5. Read the contract ( before signing). Know exactly what the guarantee does and does not cover.

Home Inspection Checklist

In the home purchasing process it is necessary perform a  Home Inspection.

There are two reasons for inspection:

  • It is VITAL that you know as much as possible about the structure and mechanics of your new  home  and its appliances.
  • The bank will want to protect it’s equity (your home)

Your Realtor should offer you a list of home inspection companies. We advise that your inspector be a member of the  The National Association of Home Inspectors.

TIP:

Sellers might consider a home inspection. This additional step and expense will  allow the home owner time to fix and repair existing problems. Many of these repairs are often unseen. Time spend in the beginning should save you frustration in the end! We make this suggestion to all our home owners in Forest Ridge.

Items usually on a home inspection checklist include:

  • Building structural and construction elements.
  • Exterior landscaping, drainage, and elevation.
  •  Roof
  •  Plumbing including pipes, showers, toilets, and faucets.
  • Air conditioners and duct work
  • The main panel and circuit breakers as well as the wiring and grounding, light fixtures and receptacles.
  • Appliances including the dishwasher, washer and dryer, and smoke detectors.
  • Within the garage area the inspector will look at the slab, walls, ceiling and vents, garage door and roof .

When completed you will have a home inspection list detailing anything that may require repair – the bottom line is your satisfaction and safety.

Two Different Types of Home Appraisal Methods

Forest Ridge offers a wonderful residential community.  When you are ready to have your home appraised, be aware that there is actually more than one way to skin the cat.

There is the sales comparison approach and the cost approach.

With the sales comparison approach you will find that the appraiser will estimate the market value of your Forest Ridge home by comparing it to other similar properties that have already sold in the neighborhood.  The actual features of the properties that are already sold may not necessarily precisely match your own home.

What happens in this case is the appraiser will simply make adjustments to the comps, as they are called.  In this manner the appraiser is able to tell you how much the similar properties would have sold for if they were exactly like your own home.

The second type of appraisal for your Forest Ridge home is the cost approach.  This is most often used with new home when the cost to build the new home is known.  If your home would ever be totally destroyed, the appraised amount from this approach would be used.  The replacement cost is important to know in this type of situation.

There are a few steps followed with the cost approach.  These include finding the estimated value of vacant land if necessary, the estimated depreciation and the cost of improvements if necessary. The actual replacement cost would figure in construction of a new home which may not necessarily match precisely the old home that was destroyed.

The appraisal is one of the more important things that you can have done for your Forest Ridge property.  Your bank will want to make sure of the value of the home in case you default on your loan.  The problems that can arise from the appraisal include having the loan declined if the property has too low a value or if the estimated sale time is longer than the houses in the same area.

The bottom line is, it is important to know the value of your home.

Why Does Your Bank Requires an Appraisal?

There are two reasons you will need  a home appraisal in Forest Ridge.

1. Purchasing a home

2. If you are looking to use your home as collateral for another loan.

Your lender will require an appraisal in order to give your home value. It is this value that  the bank will  base their loan offer.

Your appraiser should be a licensed individual. In most cases,  the appraiser must be approved by your bank.

The residential report that you receive  for your new home in Forest Ridge will be outcome of the appraisal.  This report will include, but certainly isn’t limited to, details about your home and comparisons of similar homes.

Tip:

Ask for a copy of YOUR appraisal… you have paid for it!
